The mobile game “Dream Cricket” (“Game”) is carried on under the brand name of Dream Game Studios (“DGS”) which is owned and operated by Sporta Technologies Private Limited (“Sporta”), a company incorporated under the laws of India and having its registered office at Unit No.1201-1202, 12th Floor, Wing A, One BKC, G Block, Plot No.66, Bandra Kurla Complex, Bandra-E Mumbai, Mumbai City, Maharashtra-400051, India.

For the purpose of this Privacy Policy, wherever the context so requires "You", "Your", "Yourself", "Their" or "User" shall mean any person who accesses or uses the Game. "We", "Us" or "Our" shall mean Sporta, its employees, and authorised agents that perform any services on Sporta’s behalf in relation to the Game.

This Privacy Policy ("Policy") reflects Our commitment towards protecting the privacy and personal information provided by You and sets out the nature and type of information We collect from You for the purposes outlined in this Policy, the usage and disclosure of such information, and the safety and security measures adopted by Us to safeguard such information.

Please note that this Policy is specifically applicable to the Users and the information and data gathered on or through the Game and not to any other information or website. In general, You can visit Our Game without participating in any format of the Game or revealing Your identity or any Personal Information about Yourself. However, You may not be able to access significant portions and sections of the Game or participate in any formats of the Game unless You login using Your existing account credentials on the Game and absent such credentials, create a new account to register on the Game. By accessing or using the Game in any manner or by using any content or information provided through the Game, You shall be deemed to have read, understood, accepted and agreed: (i) to be bound by the Terms available at Terms; and (ii) the Policy

Information that We may collect from You at the time of registering and creating an Account includes Your email address when it relates to the creation of a User Account and username only when it relates to the creation of Guest Account (as indicated under the Terms). Information that we may collect from You at any other time will vary depending on the activity You seek to engage in. In addition, We may collect demographic information such as information about Your mobile device, tablet, hardware, software, platform, media, Internet Protocol (IP) address and connection, information about online activity such as feature usage and click paths, and other data that You may provide in surveys or while completing Your account profiles and date and time of such access. We may combine demographic information with Personal Information to tailor Our offerings or web pages as per Your preferences or interests. Further, photographs once provided by You in relation to Your use of the Game gives Us irrevocable and unlimited rights to use the same and it is completely at Our discretion to delete or not use it any further.

We will provide You the option to withdraw consent that You have already provided with respect to the collection of Your Personal Information. Such option may be exercised by You, by writing to Us at support@dreamgamestudios.in or in such other manner as may be specified on the Game. Please note, however, that withdrawal of consent will not be retrospective and will be in accordance with the terms of this Policy, the Terms and applicable laws. However, in the event that You opt out as specified hereinabove, You may no longer be able to access certain features of the Game.

The Game or any part thereof may utilise data collection tools such as "cookies" and other tracking technologies. A "cookie" is a small text file that may be used, for example, to collect information about Your activity on the Game. Some cookies and/or other technologies We use may serve to save and/or recall information previously indicated/provided by You on the Game. If You choose to eliminate cookies, the full functionality of the Game may be impaired for You.

Our use of cookies and other tracking technologies allows Us to improve the Game, tailor the Game and its usability to Your interests, remember choices You make (such as User/Account name, email address, any information that You provide for/while accessing the Game etc.), deliver content that is most relevant to You and Your interests, and improve and enhance Your experience using the Game. We may also analyse information that does not include information for measuring traffic, User activity on the Game, trends and statistics.

You agree that the information as provided by You and the data concerning usage of the Game gathered by Us and any analysis derived therefrom, including without limitation Your Personal Information and demographic information, maybe shared, disclosed and transferred by Sporta with its affiliates and group entities to enable Our affiliates and group entities to reach out to you in relation to the offerings and/or products and/or services offered by them or with third party service providers engaged by Sporta, for the purpose of data analytics, for the purpose of storage, improving the services as well as such other purposes as may be notified to you, at the time of collection of data, from time to time, provided that the affiliate, group entity and/or third party service provider (as maybe applicable) with whom the information is shared will be required, on best efforts basis, to comply with the same standards as applicable to Sporta. By using the Game, You agree to the above, and accord Your explicit consent in respect of the disclosure, transfer, and usage of data as relates to You. In the event Sporta sells or transfers all or a portion of its business assets, or merges with or is acquired by another entity, Personal Information may be shared, disclosed or transferred as part of the transaction, provided that the entity with which the information is shared or the combined new entity (in the case of a merger) will be required, on best efforts basis, to comply with the same standards as applicable to Sporta.You hereby expressly grant consent and permission to Sporta for disclosure and transfer of Your Personal Information to such third parties.

Further, We reserve the right to share and disclose Your information with our affiliates, group entities and third parties in limited circumstances, including for the purpose of complying with applicable law, responding to duly authorised legal process, governmental requests, preventing fraud or imminent harm, acting against claims of infringement of third party rights, ensuring the security of Our network and services, protecting the rights, property and safety of Users or the general public, and otherwise enforcing compliance with the Terms and this Policy.

Where We propose to use Your Personal Information for any other uses, We will ensure that We notify You first. You will also be given the opportunity to withhold or withdraw Your consent for the use of Your Personal Information, other than as listed above or elsewhere in this Policy.

While We take best efforts to ensure that Your information including Personal Information, financial information and Sensitive Personal Information is duly protected by undertaking security measures prescribed under applicable laws, You are strongly advised to exercise reasonable discretion while providing Personal Information or financial Information while using the services given that the internet is susceptible to security breaches.

6. SENSITIVE PERSONAL INFORMATION

Sensitive Personal Information ("SPI") means such personal information which consists of information relating to Your biometric information, sexual orientation and financial information (such as bank account details or credit card numbers) and such other information specified as constituting SPI under the applicable laws of India.

Except for any SPI that You choose to provide as part of Your profile or in the course of transacting on the Game, We do not collect any SPI in the course of providing You services. Any SPI collected by Us shall not be disclosed to any third party without Your express consent, save as otherwise set out in this Policy or the Terms or as provided in a separate written agreement between Sporta and You or as required by law. It is clarified that this condition shall not apply to publicly available information, including SPI, in relation to You on the Game.

However, You acknowledge that in the course of Your participation in the Game, We may receive SPI, either when You voluntarily choose to update Your profile with information related to Your identity or from such content posted by You on the Game, and You hereby consent and agree to allow Us to store and display the SPI collected in this manner on the Game and disclose it in accordance with the terms of this Policy.

It is clarified that with respect to any SPI that You may share with Us , You have the sole right to determine whether You want to share such information with Us.

7. CONFIDENTIALITY AND SECURITY

The security of Your Personal Information is important to Us. We have implemented security policies, rules and technical measures, as required under applicable law including firewalls, transport layer security and other physical and electronic security measures to protect the Personal Information that is under Our control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss.

We will keep confidential and protect Your SPI and Personal Information, except where disclosure is required or permitted by law or in instances where use and disclosure thereof is permitted under this Policy.

We follow generally accepted industry standards to protect the SPI and Personal Information submitted to Us, both during transmission and, once We receive it, for storage and disposal. All information We gather is securely stored within databases controlled by Us. The databases are stored on servers secured behind a firewall; access to the servers is password protected and is strictly limited. No method of transmission over the internet, or method of electronic storage, is 100% secure, however. Nonetheless, We will strive our best to use commercially acceptable means to protect Your Personal Information and SPI.

We limit access to SPI and Personal Information to employees/personnel/sellers/service providers/representatives who We believe reasonably need to come into contact with that information to provide the Game to You or in order to do their jobs.

If You choose to provide Us with Your SPI and Personal Information, We may transfer that SPI and Personal Information from Your country or jurisdiction to other countries or jurisdictions around the world in accordance with applicable laws. Your SPI and Personal Information may be collected and stored on servers located in the territory of India and such other countries as We may disclose from time to time.

We retain Your Personal Information in accordance with applicable laws, for a period no longer than is required for the purpose for which it was collected or as required under any applicable law. However, We may retain data related to You if We believe it may be necessary to prevent fraud or future abuse, to enable Us to exercise Our legal rights and/or defend against legal claims or if required by law or for other legitimate purposes. We may continue to retain Your data in anonymised form for analytical and research purposes.

We have a policy of not sharing any personally identifiable information with anyone other than entities specifically authorized by Us, which may include Our advertisers, vendors, service providers and sponsors. However, We may use Your name, photo, login ID, team name and the state of Your residence or from where You are participating when announcing the results of any format of the Game. Such Game is further governed by terms and conditions which shall be available on the Game. We conduct periodic analysis and survey of the traffic to the Game for market research and advertising purposes. We reserve the right to share Your registration information with Our appointed market research and advertising companies or firms from time to time for the said purposes. If You click on a link to a third-party site or otherwise leave the Game, You will go to a platform that is outside the purview of Our control. When you register with Us, We may contact You from time to time about updating Your content to provide features which we believe may benefit You.

10. DISCLAIMER

Several deceptive emails, websites, blogs etc. claiming to be from or associated with Us may or are circulating on the internet ("Deceptive Communications") . Such Deceptive Communications may include Our logo, photos, links, content or other information. Some Deceptive Communications may call the User requesting the User to provide Account login related credentials or provide a method to commit illegal/ unauthorized act or deed or request detailed personal information or a payment of some kind. The sources and contents of these Deceptive Communications accompanying materials are in no way associated with Us. For Your own protection, We strongly recommend not responding to such Deceptive Communications . You agree that We shall not be liable for any loss, damage and harm that You may suffer by relying and/or acting upon such Deceptive Communications.

Except, as provided for the purpose of verification, as set out under the Terms, We and/or Our employees will not contact You to divulge your SPI.

11. CONDITIONS OF USE

We do not warrant that this Game, its servers, or emails sent by Us or on Our behalf are virus free. We will not be liable for any damages of any kind arising from the use of this Game, including, but not limited to compensatory, direct, indirect, incidental, punitive, special and consequential damages, loss of data, goodwill, business opportunity, income or profit, loss of or damage to property and claims of third parties.

12. CONTACTING YOU

We may contact You using the Personal Information You have given us:

• Where You have opted to receive further correspondence;
• To invite You to participate in surveys, opinion polls, etc., about Our services or otherwise (participation is always voluntary); and
• To provide You information about new services, where You have specifically agreed to receive this.

13. ACCURACY

To the extent that You do provide us with Personal Information and SPI, We wish to maintain accurate and current SPI and Personal Information. Where We collect SPI and Personal Information from You in relation to Our Game, should You need to update or correct that SPI and Personal Information, please contact Us and We will make reasonable efforts to incorporate the changes in Your SPI and Personal Information that We hold as soon as practicable. You can obtain the information We currently hold on You by emailing Us at support@dreamgamestudios.in from the email address provided to Us at the time of registering for the Game. We will use Our best efforts to send You the information within 14 days of receipt of Your email.

Your Personal Information may be retained and may continue to be used until: (i) the relevant purposes for the use of Your information described in this Policy are no longer applicable; and (ii) We are no longer required by applicable law, regulations, contractual obligations or legitimate business purposes to retain Your Personal Information and the retention of Your Personal Information is not required for the establishment, exercise or defense of any legal claim.

14. ACCOUNT AND DATA DELETION

Users are entitled to request Us to delete their Accounts and their Personal Information by sending a written request to support@dreamgamestudios.in

We will do Our best to respond promptly and in any event within one (1) month of the following:

• Our receipt of Your written request; or
• Our receipt of any further information We may ask You to provide to enable Us to comply with Your request, whichever is later.

If you proceed with permanent deactivation of your Account, You will lose access to the Game and services rendered therein, including any User data and Personal Information associated with Your Account. Users may request for Account restoration within six (6) months from the date of notification of Account deletion by Us by writing to support@dreamgamestudios.in .

When You request deletion of Your data, We follow a deletion process that ensures that Your data is safely and completely removed from Our servers or retained only in anonymised form. We try to ensure that Our services protect information from accidental or malicious deletion. Because of this, there may be delays between when You request deletion and when copies are deleted from Our active and backup systems.

15. SEVERABILITY

The invalidity or unenforceability of any provision of this Policy, in whole or in part, in any jurisdiction shall not affect the validity, legality or enforceability of the remainder of this Policy in such jurisdiction and this Policy shall continue to operate to its fullest extent, permissible under law.

16. APPLICABLE LAW

This Policy and information contained herein, shall be governed by the laws of the Republic of India without regard to conflict of law principles and any dispute arising in respect hereof shall be governed by the dispute resolution process set out under the Terms. This Policy shall apply to all Users who access and/or play the Game residing from any part of the world.
